### COMMENTARY ON DISTINCTION XXXII.
#### *On marriage with respect to the fidelity of the bed.*

*It must also be known that, whereas in all other things the husband takes precedence,* etc.

### DIVISION OF THE TEXT.

Above, the Master treated of the goods of marriage in general. Here he treats specifically of how the husband is bound to the wife, and conversely, with respect to the rendering of the debt. Now this part has two [members]. In the first he determines what the obligation is between wife and husband with respect to the fidelity of the marriage-bed. In the second he determines in what way and manner this fidelity existed in the ancient Fathers, below in the thirty-third distinction: *Here it is asked concerning the ancient Fathers* etc.

The first part has two parts. In the first he determines the manner of the obligation. In the second, the time in which the debt must be sought, there: *And although the debt is always to be rendered to the one requesting it* etc. The first part has two [members]. In the first he shows that husband and wife under this law or fidelity are judged as equals, and that the one cannot practice continence without the will of the other. In the second he confirms it by authorities, there: *But that without the consent of the wife* etc.

*And although the debt is always to be rendered to the one requesting it.* This is the second part, in which he determines concerning the time at which the debt is to be sought and rendered; and this part has two [members]. In the first he determines that the debt is not always to be sought, although it is always to be rendered. In the second he incidentally determines that it is not to be contracted at every time, and this there: *Not only in the carnal act* etc.

### TREATMENT OF THE QUESTIONS.

For the understanding of this part, inquiry is made concerning the obligation of spouses with respect to the rendering of the debt. Concerning which four things must briefly be asked.

First it is asked concerning the obligation by comparison to the vow of continence.

Second, by comparison to a supervening accident.

Third, by comparison to the time in which the debt must be sought and rendered.

Fourth, concerning the time in which nuptials ought to be celebrated.

Concerning the first, two things are asked.

First it is asked whether, after carnal union, the husband can practice continence, the wife being unwilling.

Second, whether he can practice continence, the wife being unwilling, before carnal intercourse.
